[Cannabis Smuggling Case] A Non-Prosecution Outcome Achieved by Emphasizing the Right to Remain Silen
This case involved an individual who was arrested after ordering cookies from a friend living overseas, which were later found to contain cannabis.
The client explained that they had simply received the cookies from a friend they met through social media, and had no knowledge that the cookies contained any cannabis (deny the charges).
Fortunately, message records with the friend were preserved, allowing us to argue that the client lacked the necessary intent. In addition, because the client was unable to understand Japanese, we advised them to exercise their right to remain silent during all interrogations.
The client was already experiencing anxiety due to staying in a foreign country, and being placed in detention while facing strict interrogation caused significant fear and distress. The defense counsel made every effort to visit the client as frequently as possible, offering reassurance and emotional support. We also facilitated regular communication between the client and their friends and family through counsel.
By consistently maintaining silence throughout the process, the client ultimately secured a non-prosecution decision.
