I reply, "Because no one knows yet whether they’re bad or not."
In other words, an arrested person is not necessarily a criminal.
First, some of those arrested may claim to be innocent.
Second, some of those who do confess may do so in order to protect someone else or may confess under pressure from the investigative authorities.
Even if someone has indeed committed a crime, they may not be as bad as we think.
Only by going to court can we determine whether a person has committed a crime or what punishment is appropriate.
